Terms and Conditions for using Uber Shop Products and Services

The Uber Shop Website is provided to you free of charge for your personal use, subject to these Terms and Conditions. By using Uber Shop website and services you agree to be bound by these Terms and Conditions.

1. Delivery

A. All deliveries placed up to 2:30pm on a business day are despatched in time to reach you within your selected delivery timeframe. The delivery charges for the different delivery options are listed on the delivery pages. The cut-off time for a next day delivery option is 2:30pm.
B. Before your order is to be dispatched, Uber Shop might contact you to make sure they are despatching to the correct address or that you are at the delivery address to receive your order.
C. Uber Shop will not be liable for any failed deliveries due to incorrect contact information whether that be the telephone number or in the absence of that the email or incorrect delivery address information.
D. You are responsible for making suitable arrangements to receive your delivery and giving us appropriate instructions. We reserve the right to refuse to accept orders from any customer; considerations of delivery problems may give rise to such a refusal.
E. Uber Shop is not liable in the event of the return of a parcel to our premises due to failure from part of the customer/ recipient to track their consignment.
All customers are provided with accurate and complete up-to-date tracking details and it is their responsibility to track their parcel and to ensure delivery.
The courier company informs the customer of a one hour delivery slot on the morning of the scheduled delivery. The courier company also informs customers about any problems with delivery. It is therefore the customer's responsibility to arrange for a new delivery and to ensure they receive their parcel.
Please note that in the event where no action is taken on part of the intended recipient and the customer does not track the parcel using the tracking details provided, the parcel will be returned to our premises at a return cost charged by the courier depending on the original destination of the parcel.
Should the customer require a re-delivery of the parcel, they will be responsible for the new delivery charges as relevant to the destination and urgency of the re-delivery.
F. If we are unable to deliver the order, or have to deliver late, for reasons beyond our control, for example adverse weather conditions, strike actions, vehicle breakdown, traffic congestion or supplier failure, we cannot accept liability for any inconvenience or loss this causes.

2. Cancellations and Returns

You can cancel your order anytime before we have dispatched the order. All cancellations should be made by contacting our office on 01604 760487
After dispatch you can still cancel your order by sending the product back to us in its original unopened and unused (resalelable) condition.
You will still be liable for the shipping charges we have incurred in sending the products to you.
Please note that you will be responsible for the costs of the return shipment of the items you wish to return.
We accept returns of items purchased from us up to 28 days from the time of placing the order for a full refund of the returned items.

Please send the returned items to the following address after submitting the form with the reason for the return on our "Contact us" page.
Please note that we need a written record of the reasons for the return for us to be able accept the returned items.

3. Replacement

It is our top priority to sell products of high manufacturing standards. On the odd occasion if you receive an items in a substandard condition we will send a replacement item free of charge wherever possible.
In all other cases please contact the manufacturing company directly to arrange for a replacement item. This includes all NUK and MAM products.

7. Registration

To order from Uber Shop, you must register with us. This is referred to as set up an account or register throughout our website and literature. However, this is not a credit account, payment will be required upon delivery of goods.
Please ensure that the details you provide us with are correct and complete and inform us immediately of any changes to the information that you provided when registering. You can access and update much of the information you provided us with in the My Account area of the website..

8. Password and security

When you register to use the Uber Shop Website you will be asked to create a password. If you use the website, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer to prevent unauthorised access to your account. You agree to accept responsibility for all activities that occur under your account or password. You should take all necessary steps to ensure that the password is kept confidential and secure and should inform us immediately if you have any reason to believe that your password has become known to anyone else, or if the password is being, or is likely to be, used in an unauthorised manner. Please ensure that the details you provide us with are correct and complete and inform us immediately of any changes to the information that you provided when registering. If Uber Shop has reason to believe that there is likely to be a breach of security or misuse of the Uber Shop website, we may require you to change your password or we may suspend your account.

9. Payment

Uber Shop does not hold any financial information regarding its customers and works with a third-party payment solution whereby all sensitive payment details are securely passed over a 256-bit encryption SSL certificate. You must ensure that correct and valid card details are provided.
We accept Mastercard, Visa, Solo, American Express, Maestro or Switch symbol.

10. Product purchases

You may submit orders by using our online ordering facility at any time after you have created an account. The facility allows you to review your order and make any corrections before submitting it to us and by submitting the order you confirm that you have made any such corrections. Your submission of an order amounts to an offer to enter a contract to buy the products from us; you cannot then withdraw or cancel your order except as stated below. No order is accepted from you until we confirm this by electronic communication to you or by delivering the products. A contract for our sale of products to you arises on our acceptance of your order. Where we accept an order, we do all that we can to ensure that your order is fulfilled; products are, however, subject to availability and market conditions and we do not always know if a product is or will be available at the time of accepting an order. If we are unable to deliver an item you have ordered, we will inform you of this and we will remove it from your order so that you are not charged or, if you have paid already, we will refund you the price. We will, however, bear no liability for unavailability of products. All products offered by us are subject to occasional change in price. Ordering a product from us carries with it the obligation to pay for it unless we receive from you a cancellation of or change to your orders before the deadlines published on the website. We are also happy to inform you of these deadlines by telephone if you wish to call us. You remain responsible for ensuring that any such change or cancellation is not only transmitted by you, but received by us, in time for the deadline. We reserve the right to deliver and charge in full for any order unless we have received notice of cancellation before the published deadline.

This licence does not include any resale or commercial use of this website or its contents; any collection and use of any product listings, descriptions, or prices; any derivative use of this website or its contents; any downloading or copying of account information for the benefit of another merchant; or any use of data mining, robots, or similar data gathering and extraction tools. This website or any portion of this website may not be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose without our express written consent. You may not frame or use framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of Uber Shop and its affiliates without express written consent. You may not use any meta tags or any other "hidden text" utilising Uber Shop 's or its affiliates' names or trademarks without the express written consent of Uber Shop. Any unauthorised use terminates the permission or license granted by Uber Shop. 12. Availability of the website

Although Uber Shop aims to offer you the best service possible, we make no promise that our website services will meet your requirements and we cannot guarantee that the service will be fault free. If a fault occurs in the service, please report it to us (see below for contact details) and we will correct the fault as soon as we reasonably can. Your access to the Uber Shop Website may be occasionally restricted to allow for repairs, maintenance or the introduction of new facilities or services. We will restore the service as soon as we reasonably can. In the event that our website is unavailable, our usual order and cancellation deadlines apply; please notify us of changes to your order via email or telephone

15. Uber Shop 's right to cancellation

Uber Shop may suspend or cancel any accepted order or your registration immediately at our reasonable discretion or if you breach any of your obligations under these Terms and Conditions. You can cancel your registration with us at any time by informing us in writing. If you do so, you must stop using Uber Shop services, including this website. The suspension or cancellation of your registration shall not affect either party's rights or liabilities accrued to the date of termination or any orders submitted by you before we received notice of your cancellation, and you will continue to be bound by such orders.
Any other provisions of these Terms and Conditions applicable to the use of the Uber Shop website shall survive cancellation.

16. Uber Shop's liabilities

The Website is provided by Uber Shop as is without any warranties or guarantees save those set out in these Terms and Conditions.
Whilst Uber Shop tries to ensure that material included on the Uber Shop website is correct, reputable and of high quality, we cannot accept responsibility if, despite our endeavours, this is not the case. Without prejudice to your statutory rights, Uber Shop will not be responsible for any errors or omissions or for the results obtained from the use of such information or for any technical problems you may experience with the Uber Shop Website. If Uber Shop is informed of any inaccuracies in the material on the website, we will attempt to correct the inaccuracies as soon as we reasonably can. We disclaim all liabilities in connection with the following:
(a) technical problems including errors or interruptions of the Uber Shop Website but we will use reasonable endeavours to correct or avoid them

We shall not be liable for any delay in or failure to perform any of our obligations if the delay or failure is caused by circumstances beyond our reasonable control including, without limit, difficulties or failures of our suppliers.
A person who is not a party to these Terms and Conditions shall have no right under the Contract (Rights of Third Parties) Act 1999 to enforce any term of these Terms and Conditions but this shall not affect any right or remedy of a third party which exists or is available apart from that Act.

18. Alteration of Service or Amendments to the Conditions

We may update these Terms and Conditions from time to time and any changes will be notified to you via the e-mail address provided by you on registration or via a suitable announcement on the Uber Shop website. The changes will apply to the use of the Uber Shop Website after we have given notice. If you continue to use the Uber Shop website after the date on which the change comes into effect, your use of the Uber Shop website indicates your agreement to be bound by the new Terms and Conditions.
